Terms and Conditions of Service

1. Parties to the Agreement

This Agreement (“Agreement”) is entered into between Karl Mifsud, trading as Bullet Proof
Resurfacing (“Service Provider”), located at 13 Amazon Place, Kearns, NSW 2558, and the
client engaging the services (“Client”).

2. Services Provided

The services provided by Bullet Proof Resurfacing include but are not limited to pressure
washing, soft washing, and resurfacing services, encompassing the preparation and
application of epoxy and Polyaspartic products.

3. Payment Terms

  • a. Pressure Washing and Soft Washing:
    All payments for pressure washing and soft washing services are to be made in full upon
    completion of the works.
  • b. Resurfacing:
    For resurfacing services, a 30% deposit is required to engage the services. An additional
    30% payment is due upon completion of the preparation stage. The final 40% is to be paid
    upon completion of all works carried out.

4. Insurance Coverage

Bullet Proof Resurfacing holds public liability insurance to the value of 20 million.
This insurance coverage is designed to protect both parties in the event of unforeseen
circumstances.

5. Care and Damage Prevention

Bullet Proof Resurfacing will take all necessary care to prevent damage to the Client’s
property during the provision of services. However, the Service Provider shall not be held
liable for any damage caused as a result of the services, including but not limited to,
pressure washing, soft washing, and resurfacing.

6. Limitation of Liability

In no event shall Bullet Proof Resurfacing be liable for any indirect, consequential,
incidental, special, or punitive damages, including, but not limited to, loss of profits,
business interruption, or loss of data, arising out of or in connection with the services
provided.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state
of New South Wales, Australia.

8. Dispute Resolution

Any disputes arising out of or in connection with this Agreement shall be resolved through
negotiation in good faith between the parties. In the event that a resolution cannot be
reached, the parties agree to submit the dispute to mediation in accordance with the rules
of the Australian Mediation Association.

9. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes
all prior agreements, whether written or oral, relating to the subject matter hereof.

10. Modification

No modification of this Agreement shall be valid unless in writing and agreed upon by both
parties.

12. Confidentiality

Bullet Proof Resurfacing acknowledges the confidential nature of the Client's property and
premises. All information obtained during the provision of services, including but not limited
to access codes, security details, and personal preferences, will be treated with the utmost
confidentiality. Such information will not be disclosed to third parties without the explicit
consent of the Client, except as required by law.

13. Work Schedule and Completion Timeframe

Bullet Proof Resurfacing will make reasonable efforts to adhere to the agreed-upon
schedule for services. The Client understands that unforeseen circumstances, such as
weather conditions or unexpected issues during the process, may cause delays. Bullet Proof
Resurfacing will communicate promptly with the Client regarding any changes to the initial
timeframe and will strive to complete the services in a timely manner.

14. Materials and Product Selection

The Client acknowledges that Bullet Proof Resurfacing will select materials and products of
professional quality for the services. The Service Provider reserves the right to make

substitutions based on availability, ensuring that the quality and performance meet or
exceed the initially agreed specifications.

15. Access to Premises

The Client agrees to provide safe and unobstructed access to the premises for Bullet Proof
Resurfacing during the agreed-upon service hours. If access is restricted or delayed, Bullet
Proof Resurfacing may adjust the service schedule accordingly, and any resulting additional
costs will be communicated to the Client.

16. Warranty and Guarantee

Bullet Proof Resurfacing provides a 5-year warranty on workmanship for the resurfacing
services. This warranty covers defects resulting from the application process and adherence
to product specifications. Any issues arising within the warranty period will be addressed
promptly by Bullet Proof Resurfacing, at no additional cost to the Client.

17. Substrate Movement and Rising Damp Clause

The Client acknowledges that movement in the substrate or rising damp may occur
independently of the resurfacing services provided by Bullet Proof Resurfacing. In the event
that product failure or issues arise due to such substrate movement or rising damp, the
Service Provider shall not be held liable for any resulting claims or damages. The Client
accepts responsibility for addressing any structural or environmental issues that may affect
the performance of the resurfacing products.

18. Variation in Colour or Finish

The Client acknowledges that when selecting a colour or finish for the services provided by
Bullet Proof Resurfacing, the final appearance may vary from the samples presented on the
website, physical samples, or digital representations. This discrepancy may arise due to
variations in product batches, application methods, and other factors inherent in the
resurfacing process.
Bullet Proof Resurfacing will make reasonable efforts to match the chosen colour or finish to
the best of its ability. However, the Client understands and accepts that exact replication
may not be achievable, and minor variations may occur. Such variations do not constitute a
defect in the services provided, and Bullet Proof Resurfacing shall not be held liable for any
perceived discrepancies in colour or finish.

19. Safety

Bullet Proof Resurfacing prioritises safety in all aspects of its operations. All work carried out
by the Service Provider will be conducted in a safe and professional manner. The Service
Provider reserves the right to refuse to carry out any work that cannot be performed safely.

Each job site will have an independent safety plan created, outlining potential risks and
necessary precautions. Clients will receive a brief on the identified risks for both them and
the workers involved in the project.
Safety data sheets and product data sheets will be provided to the Client prior to the
commencement of works, offering comprehensive information on the products and
materials used in the services.

20. Environmental Protection

Bullet Proof Resurfacing is committed to environmental protection. The Service Provider will
take all required steps to prevent spillage and waste from entering waterways. In the event
of any accidental spillage, the Service Provider will implement immediate containment and
cleanup measures to mitigate environmental impact.
By engaging Bullet Proof Resurfacing's services, the Client acknowledges and agrees to the
terms and conditions outlined herein.
