Company”). It outlines the warranty terms and conditions for products and services provided by the Company. Our aim is to offer clarity on warranty coverage, ensuring our clients understand the scopeof protection for their investments in our products and services.

ARTICLE 1: WARRANTY COVERAGE

1.1 General Coverage:

Karl Mifsud, trading as Bullet Proof Resurfacing, extends a warranty covering the integrity of
workmanship and the performance of the products applied in the application/installation of Epoxy and Polyaspartic flooring systems. Specifically, this warranty encompasses a 10-year term for products sourced from Rhino Linings and a 5-year term for products sourced from APC or other suppliers,ensuring that the application will not fail and the product will perform as expected under normalusage conditions within internal residential areas, including garages.

1.2 Specific Inclusions:

This warranty explicitly covers any defects in the application process of Epoxy and Polyaspartic
flooring systems within internal residential areas, including but not limited to improper surface
preparation, and any inherent defects in the product itself that result in poor adhesion, premature
coating failure, or any other performance issues. Our commitment ensures that your space, whether a garage, living area, sunroom, or any other resurfaced internal area, retains its aesthetic appeal and functional integrity throughout the warranty period.

1.3 Scope of Application:

Coverage is provided for residential applications to the original purchaser, covering internal areas
such as garages, living areas, and sunrooms. This warranty aims to address and rectify any issues that do not meet our stringent standards for quality and performance in these specified areas, reinforcing our commitment to excellence and customer satisfaction.

ARTICLE 2: WARRANTY LIMITATIONS

2.1 Limitation on Remedies:

Should a defect covered by this warranty occur, Bullet Proof Resurfacing’s responsibility is strictly
limited to the repair or replacement of the defective area. This warranty does not extend to any
indirect or consequential damages or losses incurred as a result of the defect. Our approach focuses on Bullet Proof Resurfacing Page 2 of 4 rectifying the issue directly at its source, ensuring the longevity and performance of the resurfaced area.

2.2 Extent of Coverage:

The remedies provided under this warranty, namely repair or replacement, will be carried out usingequivalent materials and techniques to maintain the integrity and aesthetics of the resurfaced area.Bullet Proof Resurfacing reserves the right to determine the most appropriate remedy on a case-by-case basis, ensuring the best outcome for the client while maintaining the standards of our service offering.

ARTICLE 3: EXCLUSIONS

3.1 Excluded Circumstances:

3.1.1 : Damage attributable to “Rising Damp” conditions, wherein moisture from the ground rises
through the concrete, is not covered under this warranty. Such conditions require preventative
measures beyond the scope of surface resurfacing.

3.1.2 : Direct damage resulting from the application of solvents, exposure to extreme pressure
washing techniques, or flooding, which compromises the integrity of the resurfaced area, will
void the warranty. These actions are beyond the intended use and expected environmental
conditions for the product.

3.1.3 : The use of cleaning systems or products not approved by Bullet Proof Resurfacing may result in damage not covered by this warranty. It is imperative that only recommended products and techniques are used to maintain the condition of the resurfaced area.

3.1.4 :  Normal wear and tear from residential usage, reflective of the passage of time and regular use, is considered acceptable and is thereby excluded from warranty coverage. This exclusion
acknowledges the natural aging process of materials under normal conditions.

3.1.5 :  Damage caused by the use of heavy equipment, abrasive grinding, cutting activities, or any
form of commercial application exceeds the scope of residential use and is not covered by this
warranty. Such activities introduce stresses and conditions beyond those anticipated in a
residential setting.

ARTICLE 4: TRANSFERABILITY

4.1 Non-Transferability of Warranty:

The warranty provided by Bullet Proof Resurfacing is exclusively for the benefit of the original
purchaser of the resurfacing service and is not transferable under any circumstances. This condition ensures that the warranty remains with the individual who initially engaged the services of Bullet Proof Resurfacing, maintaining a direct line of accountability and service quality. Transfer or sale of the property on which the service was performed does not confer the right to claim under this warranty to subsequent owners.

ARTICLE 5: WARRANTY ACTIVATION

5.1 Warranty Activation Requirements:

The warranty becomes effective only after full payment for the service has been received by Bullet
Proof Resurfacing. Proof of payment must be retained by the purchaser and presented upon request to validate a warranty claim

ARTICLE 6: EXCLUSION OF UNAUTHORIZED MODIFICATIONS

6.1 Modifications Voiding Warranty:

Any modifications, alterations, or repairs made to the resurfaced area by parties other than Bullet
Proof Resurfacing or without the express written consent of Bullet Proof Resurfacing will void the
warranty. This includes, but is not limited to, color changes, application of additional coatings, or
structural modifications.

ARTICLE 7: ENVIRONMENTAL AND USAGE CONDITIONS

7.1 Proper Use and Maintenance:

The warranty assumes that the resurfaced area will be subjected to normal residential use and
maintained according to the care instructions provided by Bullet Proof Resurfacing. Failure to adhere to recommended care and maintenance guidelines will void the warranty.

7.2 Environmental Limitations:

This warranty does not cover damage or defects resulting from environmental conditions beyond the control of Bullet Proof Resurfacing, including but not limited to, natural disasters, extreme weather conditions, and chemical exposure not consistent with normal residential use.

ARTICLE 8: CLAIM PROCESS

8.1 Initiating a Claim:

To initiate a warranty claim, the original purchaser must contact Bullet Proof Resurfacing directly,
providing proof of purchase and a detailed description of the issue. This documentation is essential for verifying the validity of the claim and ensuring a swift resolution process.

8.2 Inspection and Assessment:

Upon receipt of a claim, Bullet Proof Resurfacing reserves the right to inspect the resurfaced area in question to assess the validity of the claim. This inspection will determine whether the issue falls
within the scope of the warranty coverage and adheres to the terms and conditions outlined herein

8.3 Resolution of Valid Claims:

For claims deemed valid, Bullet Proof Resurfacing commits to repairing or replacing the affected area at no additional cost to the customer. The chosen method of resolution will be at the sole discretion of Bullet Proof Resurfacing, aimed at restoring the integrity and aesthetics of the resurfaced area in accordance with the original service agreement.

8.4 Timeframe for Claim Submission:

This timeframe is critical to ensure timely assessment and remediation of any issues, maintaining the high standards of quality and customer satisfaction upheld by Bullet Proof Resurfacing.

ARTICLE 9: GENERAL

9.1 Amendments to Warranty Terms:

Bullet Proof Resurfacing reserves the right to amend or update the warranty terms and conditions at any time without prior notice. Such changes will be made to reflect evolving business practices,
product offerings, and to ensure the continued protection of both the client and the company. Clients are encouraged to review the warranty terms periodically for any updates.

9.2 Governing Law and Dispute Resolution:

Any disputes arising under this warranty will be governed by the laws of New South Wales, Australia, and resolved through arbitration. This clause ensures a structured and fair process for resolving any disagreements, with a focus on impartiality and adherence to legal standards.

9.3 Warranty Disclaimers:

APART FROM THE WARRANTY COVERAGE EXPRESSLY PROVIDED IN THIS DOCUMENT,
BULLET PROOF RESURFACING DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR
IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER
UNDERSCORES THE SPECIFICITY OF THE WARRANTY TO THE SERVICES AND
PRODUCTS PROVIDED BY BULLET PROOF RESURFACING, DELINEATING THE SCOPE OF
COVERAGE FOR CLIENTS.
